Flogapp Terms of Service

  1. Introduction
    1. FLOGAPP, a limited liability company registered in the United Arab Emirates
      (UAE), trading under the name FLOGAPP PORTAL, as defined under the
      Privacy Policy, and as available on the Flogapp website and mobile application, for further information
      click, Privacy Policy. Flogapp with its registered offices located in Dubai, United Arab Emirates
      (hereby referred to as “Flogapp”). Flogapp, provides these terms and conditions to
      inform its users; freelancer, buyers, and other visitors browsing the application (collectively referred
      to as “Users”) of the terms of service regarding the procedures, policies and use of
      the Flogapp website or mobile application, (hereby referred to as “Flogapp Platforms”).
      By accessing and/or using the Flogapp Platforms and/or registering for a Flogapp account, you hereby
      agree to the Flogapp terms and conditions and Privacy Policy, including but not limited to; our
      collection, use, disclosure, processing and retention of personal information and any similar action,
      thereof, (hereby referred to as “Terms of Service”). These Terms of Service, governs
      and guides your access to and use of the Flogapp Platforms, including any content, function and services
      offered onto the Flogapp Platforms.
    2. By using the Flogapp Platforms, opening an account, or by clicking to accept or agree to the Terms of
      Service, you hereby irrevocably accept and agree, on behalf of yourself or on behalf of any party which
      you represent, to be legally bound by and abide by the following Terms of Service, which includes
      without limitation our Privacy Policy, of which is incorporated herein by reference. If you do not want
      to agree to these Terms of Service and Privacy Policy, you must not access or use the Flogapp Platforms.
      By using the Flogapp Platforms, you represent and warrant that you are of legal age to form a binding
      agreement and meet all of the foregoing eligibility requirements. If you do not meet all of these
      requirements, you must not access or use the Flogapp Platforms.
    3. Our Customer Support team is available from Monday till Saturday from 9.00 AM to 6.00 PM if you have any
      inquiries regarding any of the Flogapp Platforms or its Terms of Service and/or Privacy Policy. Users

    4. The original language of these Terms of Service, as well as all other texts throughout the Flogapp
      Platforms, is English. In case of conflicts between the original English version and any translation,
      the English version shall prevail.
    5. The Flogapp Platforms is offered subject to your acceptance without modification of all the Terms of
      Service, contained herein and all other operating rules, policies including, without limitation, the
      Privacy Policy and procedures that may be published from time to time on this any Flogapp Platform.
    6. The Flogapp Platform offers a range if different services, including but not limited to, freelancer
      services within a wide range of different professions and fields. All freelance services are provided by
      third-party providers that have met Flogapp Platform registration requirements. Although Flogapp
      requests that third party freelancers offer the highest possible quality of work in regards to each
      professions industry standards, Flogapp Platforms are not held liable for any paid work done by and
      between the freelancer and the User(s) that does not satisfy the desired industry standards of that
      freelancers profession.
    7. Flogapp Platforms offer different Home-Services via registered companies within the UAE that offer said
      services through Flogapp Platforms. Flogapp Platforms are not held liable for any paid work done by and
      between the registered companies and the User(s) that does not satisfy industry standards.
  2. License to use Flogapp Platforms;
    1. In direct accordance with the acceptance of these Terms of Service, Privacy Policy and any of the
      relevant laws of the Federal Laws of the United Arab Emirates (hereby referred to as the
      “Relevant Laws”), Users hereby declare, the following;
    2. In relation to, all copyrights and other intellectual property rights or anything related to Flogapp
      Platforms; (including all new releases and updates) shall accrue exclusively to Flogapp. The User shall
      receive a right to use the Flogapp Platforms, in accordance with the following Terms of Service.
    3. The User may reproduce the software insofar as is necessary for use of the software within the scope of
      the license. Necessary reproductions include the installation of the software on the agreed number of
      computers as well as the loading into the random-access memory (RAM) of the computers. The Licensee may
      transfer the software from one computer to another provided the agreed number of installations is not
      thus exceeded.
    4. The Licensee may make necessary back-up copies of the software. A back-up copy on a movable data medium
      shall be designated as such and a copyright notice affixed to it. The Licensee may not modify or remove
      copyright notices within the software or other features serving to identify the program.
  3. Registration, Use and Switch of User A ccounts;
    1. Once an individual opens up any of the Flogapp Platforms he/she may register for an account within
      Flogapp Platforms by completing and submitting the account registration form on our Flogapp Website or
      Mobile Application, and clicking on the verification link in the email that Flogapp will send to you.
    2. Users may not allow any other person to use their account to access any of the Flogapp Platforms.
    3. Users must notify Flogapp in writing immediately if he/she becomes aware of any unauthorized use of
      their account.
    4. Users must not use any other person’s account to access any Flogapp Platform.
    5. Users can either be; User (Freelancer)/s or Client/s. Upon the Flogapp account registration as per
      Section 3.1.1, the User may choose/switch between either User options upon their desired needs from the
      Flogapp Platform.
    6. In accordance to Section 3.1.5 above, The User may switch account types, pending the satisfaction of
      regulatory requirements as per the Relevant Laws and the payment of fees necessary as per Section 7,
      below. The User hereby acknowledges and accepts that once the switch in accounts has been made, this
      shall be a permanent switch and shall be dealt with by Flogapp according to said switch in accounts.
  4. User Login Details and Account Security;
    1. Upon the registration of an account within the Flogapp Platforms, Flogapp will provide you with or ask
      the User to choose his/her username and password. Therefore, in accordance with the above, the User
      hereby agrees to the following;
      1. User ID must not be liable to mislead and must comply with the content rules set out these Terms
        of Service.
      2. To not use your account or user ID for or in connection with the impersonation of any person.
      3. To keep their password confidential.
      4. To notify Flogapp in writing immediately if they become aware of any disclosure of their
        password.
      5. To accept the responsibility for any activity on Flogapp Platforms arising out of any failure to
        keep your password confidential, and may be held liable for any losses arising out of such a
        failure.
      6. Flogpp will not be liable for any acts or omissions by user (client or Freelancer), including
        any damages of any kind incurred as a results of such acts or omissions. Flogapp may suspend ,
        disable or delete your account (or any part thereof) if Flogapp determine that you have violated
        any provision of this agreement or that you conduct or content would tend to damage our
        reputation and goodwill. If we delete your account for the foregoing reasons, you may not
        re-register for our services. Flogapp may block your email address and internet protocol address
        to prevent further registration.
  5. Cancellation and Suspension of Account;
    1. Users may at any time and in their sole discretion without notice or explanation cancel their account,
      subject only to the satisfaction of payment terms as set out in Section 7, below.
    2. Flogapp may in accordance with these Terms of Service suspend a User account as it deems fit for the
      violation/breach of any and/or all sections of these Terms of Service.
    3. Users may cancel their account on the Flogapp Website/Mobile Application using the User account control
      panel on the Flogapp Website.
  6. Uploaded Content and Intellectual Property Rights;
    1. In these Terms of Service, any and all works and materials (including without limitation; text,
      graphics, images, audio material, video material, audio-visual material, scripts, software and files)
      that you submit to us or any Flogapp Platform for storage or publication on, processing by, or
      transmission via, our website. (Hereby collectively referred to as “Uploaded Content”)
    2. Users hereby grant to Flogapp, a worldwide, irrevocable, non-exclusive, royalty-free license to; use,
      reproduce, store, adapt, publish, translate and distribute your content in any existing or future media,
      and/or reproduce, store and publish your content on and in relation to any Flogapp Platform and any
      successor platforms created by Flogapp.
    3. Users hereby grant to Flogapp, the right to bring an action for infringement of the rights licensed.
    4. Users hereby waive all moral rights within the Uploaded Content to the maximum extent permitted by the
      Relevant Laws; and you warrant and represent that all other moral rights in your content have been
      waived to the maximum extent permitted by the Relevant Laws.
    5. Users may edit the Uploaded Content to the extent permitted using the editing functionality made
      available on Flogapp Platforms.
    6. Without prejudice to other rights under these Terms of Service, if you breach any provision of these
      Terms of Service in any way, or if we reasonably suspect that you have breached these Terms of Service
      in any way, we may delete, unpublish or edit any or all of the Uploaded Content.
    7. Users warrant and represent that your content will comply with these Terms of Service.
    8. Uploaded Content must not be illegal or unlawful, must not infringe any person’s legal rights, and must
      not be capable of giving rise to legal action against any person (in each case in any jurisdiction and
      under the Relevant Laws).
      Uploaded Content and the use of the content in accordance with these Terms
      of Service, must not be; libelous and/or maliciously false, obscene and/or indecent; infringe any
      copyright, moral right, database rights, trademark rights, design rights, rights in passing off, or any
      other intellectual property right, infringe any of confidence, right of privacy or right under data
      protection legislation, constitute negligent advice or contain any negligent statement, therein.
      1. Uploaded Content and the use of the content in accordance with these Terms of Service, must not;
        constitute an incitement to commit a crime, instructions for the commission of a crime or the
        promotion of criminal activity, be in contempt of any court, or in breach of any court order,
        breach of any racial or religious hatred or discrimination legislation, be blasphemous, breach
        of official secret legislations, breach of any contractual obligation owed to any person, depict
        violence, in an explicit, graphic or gratuitous manner, offensive deceptive, fraudulent,
        threatening, abusive, harassing, anti-social, menacing, hateful, discriminatory, cause
        annoyance, inconvenience, needless anxiety to any person, pornographic, suggestive or sexually
        explicit, be true, false, inaccurate or misleading.
  7. Payment, Fees and Refunds;
    1. By agreeing upon the Terms of Services, and once the User is a registered User of the Flogapp Platforms,
      be it a User (freelancer) or User (Client), you hereby agree to pay the annual and monthly fees as per
      schedule below, (Section 7.5).
    2. Payments will be due as of the first day you sign up for a Flogapp Platform Service, and will cover an
      annual period, as indicated when signing up.
    3. Configurations and prices of the Flogapp Platform Services are subject to change at any time, and
      Flogapp shall at all times be entitled to modify configurations, fees, prices and quotations, provided
      that no price changes shall be made applicable to you during a subscription term, and shall only take
      effect after Flogapp and the User have agreed upon an extension, upgrade or renewal of the subscription
      term.
    4. The monetary amount of, twenty-five (25) AED will be deducted from User (Freelancer) on your total
      weekly accepted and paid jobs as bank transfer charges.
    5. Flogapp Platforms are considered an E-marketplace, Flogapp platform facilitating this electronic meeting
      ground by supplying a medium through which Flogapp Users can connect with services professionals,
      schedule certain services and make payments for certain home services. Flogapp Platforms shall not be
      held liable for any liability that may arise from any of the Users.
    6. Home Services User(s) go into direct agreement with service professional on any of the Flogapp Platform.
      Flogapp is Platforms only providing a marketplace for both Freelancers/Home Service Providers and the
      User(s) and are not held liable for any damage or dissatisfaction with any of the services provided by
      any serving party.
    7. Flogapp Home Services charges a fee from the total amount paid by Users to service professionals for
      each respective service booked and performed by using any of the Flogapp Platforms.
    8. Flogapp Home Services utilizations fee shall be deducted accordingly by Flogapp from the total amount
      received by a service professional from a User for each service.
    9. Flogapp Platforms accept all forms of payment applied within the United Arab Emirates (UAE) (i.e, visa;
      debit credit card & apple pay, etc)
    10. Flogapp Platforms shall deal in the currency of United Arab Emirates Dirham (AED), any payments made
      through other currencies shall be subject to the applicable currency rates as per the rates applicable
      on the date of payment.
    11. Flogapp Home Services Users are obligated to pay in advance for the booked services through the Flogapp
      Platforms prior to said service being approved by either Flogapp or the Home Service Provider. the User
      hereby authorizes the company to charge the chosen payment method on the Users account. Once the
      transaction is successfully completed, Flogapp shall send a confirmation notice to the User by push
      notification.
    12.  Flogapp Home Services Users will use third party services to process credit card information, by
      accepting these Terms of Service, you hereby grant Flogapp (or third-party payment processor on the
      Flogapp behalf) permission to charge the chosen method of payment registered on the Users Account.
    13.  The User hereby accepts that all information that he/she has provided in connection with a
      purchase of transaction or other monetary transactions interaction with the service must be accurate,

    15. Service Fees;
      1. Flogapp shall deduct a fixed percentage of ( 15%) for all Membership Package
        Categories, as detailed in  Section 7.5, above. Said percentage will be deducted
        from the User (freelancer)s invoice per order/service.
    16. Refunds;
      1. Users may request a refund within  48  hours or 
        two ( 2days from the time of the order/service has been
        paid on Flogapp. This shall exclude without limitation or exception, the Applicable Fees and any
        other charge as Flogapp deems fit.
      2. Upon satisfaction of refund conditions, Flogapp may agree to the refund, the User will receive
        the funds via the same payment method(s) that they used to make the original payment to Flogapp.
      3. Flogapp may refund funds to a User irrespective of whether a User has requested funds be
        refunded, upon the satisfaction of the following;
        1. Flogapp is required by law or by arbitration award; and/or
        2. Flogapp determine that refunding funds to a User will avoid any unnecessary dispute;
          and/or

        3.  
          Flogapp refund funds to a User in accordance with any refund policy specified by
          Flogapp; and/or
        4. Flogapp and any relevant third party (i.e Bank Compliance Department) find out that the
          original payment made by User is fraudulent; and/or
        5. User has made a duplicate payment in error; and/or
        6. Flogapp consider, in its sole opinion, that it is likely that the refund of funds is
          necessary to avoid a credit card chargeback.
      4. Users may request a refund by emailing us at  support@flogapp.com .
      5. Once a User has made a Payment a User expressly agrees to use the dispute resolution as
        described in Section (15) of these Terms of Service, process and expressly agree to be bound by
        its ruling and expressly agree not to initiate any chargeback request with card issuer.
      6. If User initiates any chargeback request or similar process, a User expressly agrees and
        consents Flogapp to share any and all information in relation to your agreement to these Terms
        of Service, in order to defeat any such chargeback request.
      7. If Flogapp reasonably suspects, having considered all the relevant circumstances, that User has
        made an excessive or unreasonable number of requests to refund funds back or chargebacks,
        Flogapp may suspend, limit or close the User Account.
  8. Payment Services & Fund Transfer;
    1. User (freelancer) Transfer Method Fee: Upon the Users (User (freelancer)) request,
      funds are to be disbursed via a wire transfer, a User (freelancer) Transfer Method Fee will be charged
      to the User (User (freelancer)).
    2. Flogapp Invoice Service; enables Users (User (freelancer)s) to issue invoices and
      enables User (client) to make payments for services.
    3. All transfers shall be made through the use of  MY
      FATOORAH
       payment gateway.
    4. Users (User (freelancer)s) will complete the electronic invoice form (the “ Invoice“)
      and submit it to Flogapp via the Flogapp Website. A User (User (freelancer)s) must complete and submit
      an Invoice to Flogapp for each and every payment.
    5. MY FATOORAH; enables User (client) to transfer certain payment responsibilities to
      FLOGAPP.
    6. At a User’s (client’s) request, upon payment to Flogapp for services rendered by another User (User
      (freelancer)), Flogapp will assume responsibility for the payment for such User’s (User (freelancer)’s)
      services (this will be subject to less Service Fee upon Flogapp’s sole discretion).
    7. Flogapp agrees not to pay User (User (freelancer)) for services until after the occurrence of a User’s
      (client) acceptance and confirmation of the User’s services. The User acknowledges that such funds will
      belong to Flogapp immediately upon transfer of funds to Flogapp.
    8. Upon the unsatisfaction of services rendered between Users and the User (client) has paid for, the User
      (User (freelancer)) may notify Flogapp within (15) fifteen days from confirmation of order between
      Users.
    9. Flogapp will attempt to resolve the concerns within (7) seven days from date of notification.
    10. Flogapp agrees to keep Users informed as to the status of the Assumed Payment Liability.
    11. In case User (client) terminates the engagement prior to work completion without proper reason or
      justification, the User (client) will still be obligated to pay the work fee for the User (User
      (freelancer)) and Flogapp and the Applicable Fees and Charges for work done, and for expenses and
      disbursements incurred, up to the date of termination, plus any transaction fee charged by Flogapp,
      thereof.
    12. If User reasonably disputes the quality or completion of services provided by such User (freelancer),
      then User agree that Flogapp shall have no payment obligations to any party related to relevant fees.
    13. To receive due funds; the User must request such funds and indicate your  selection of the funds
      transfer methods available on the Application. Any such requests shall be subject to the conditions and
      restrictions contained on the Application and in these Terms of Service. Notwithstanding any other
      provision of these Terms of Service, if FLOGAPP determines in its sole discretion that a Registered User
      has violated the conditions and restrictions of the Application or Terms of Service, FLOGAPP has the
      right to refuse to process such request.
    14.   Hold On Transfers; Flogapp, reserves the right, at its sole
      discretion, to place a hold on requested transfers if Flogapp suspects funds may be subject to charge
      back, bank reversal, failure to clear or fraud. Flogapp  will release a Hold On Transfers, as it
      deems fit.
    15. Release and Delivery of Amounts to Flogapp; Users hereby irrevocably authorize and
      instruct Flogapp to release applicable portions of the Fixed Price Flogapp Account (each portion, a “
      Release”) to User Account, as applicable, upon the occurrence of and in accordance with
      one or more Release Conditions provided below or as otherwise required by the Relevant Laws or the Terms
      of Service. The amount of the Release will be delivered to the applicable User Account in accordance
      with Users instructions, as applicable.
    16. Release and Delivery of Amounts from Flogapp; Flogapp shall release the amount due to
      the User (User (freelancer)) within the minimum time of ( 20) twenty working days and a
      maximum time of ( 40) forty working days.
    17. Release Conditions; shall hold the meaning as follows;
      1. User (client) clicks to release funds to User (User (freelancer)).
      2. User (client) does not take any action for (7) days from the date of a User (freelancer)’s
        Release request, in which case User (freelancer) and User (client) agree that Flogapp is
        authorized and irrevocably instructed to immediately release to User (freelancer) the amount
        associated with to the applicable milestone in connection with such Release request.
      3. User (freelancer) cancels the service contract before a milestone payment has been released to
        User (freelancer), in which case the funds are to be returned to the User (client).
      4.  User (client) and User (freelancer) have submitted joint written instructions for a
        Release to either User Account, as applicable.
      5. User (client) and User (freelancer) agree to close the contract without release of funds, in
        which case the funds are to be returned to the User (client).
  9. Limitation of Liability and Warranty;
    1. Flogapp hereby declares that the limitations and exclusions of liability as set out in these Terms of
      Service shall include but not be limited to;
      1. All liabilities arising under these Terms of Service and Privacy Policy, including liabilities
        arising in contract, and for breach of statutory duty, except to the extent expressly provided
        otherwise in these Terms of Service.
      2. To the extent that the Flogapp Platforms and the information and services provided are utilized,
        we will not be liable for any loss or damage of any nature.
      3. Any and all liability to Users in respect of any losses arising out of any event or events
        beyond our reasonable control.
      4. Any liability and all to Users in respect of any business losses, including without limitation;
        loss of or damage to profits, income, revenue, use, production, anticipated savings, business,
        contracts and commercial opportunities.
      5. Any liability to Users in respect of any loss or corruption of any data, database or software.
      6. Any liability to Users in respect of any special, indirect or consequential loss or damage.
    2. Users hereby accept that Flogapp have an interest in limiting the personal liability of Flogapp;
      employees, managers, consultants, partners or any person who formulates part of the Flogapp team (hereby
      collectively referred to as “Flogapp Team”). Having regard to that interest, you
      acknowledge that we are a limited liability entity; you agree that you will not bring any claim
      personally against Flogapp Team in respect of any losses you suffer in connection with the Flogapp
      Platforms, this will not, limit or exclude the liability of the limited liability entity itself for the
      acts and omissions of our Flogapp Team.
    3.  Further to  Sub-sections (9.1 and 9.2), Flogapp hereby declares that we
      do not warrant or represent;
      1. The completeness or accuracy of the information published on Flogapp Platforms or the material
        on the Flogapp Platforms is up to date; or that any service will remain available.
      2. We further reserve the right to discontinue or alter any or all of our Flogapp Platform
        services, at any time in our sole discretion without notice or explanation; and save to the
        extent expressly provided otherwise in these Terms of Service, you will not be entitled to any
        compensation or other payment upon the discontinuance or alteration of any Flogapp Website
        services, or if we stop publishing the Flogapp Website.
      3. To the maximum extent permitted by the Relevant Laws and/or any applicable laws; we exclude all
        representations and warranties relating to the subject matter of these Terms of Service, in
        relation to the Flogapp Platforms.
  10. Breach of Terms of Service;
    1. Without prejudice to Flogapp’s other rights under these Terms of Service, if the User breaches these
      Terms of Service in any way, or if Flogapp reasonably suspect that the User has breached these Terms of
      Service. Flogapp reserves the right to;
      1. Temporarily suspend your access to Flogapp Platforms; and
      2.  Permanently prohibit you from accessing Flogapp Platforms;
      3. Send you one or more formal warnings; and
      4.  Block computers using your IP address from accessing the Flogapp Website;
      5.  Contact any and all of our Internet service providers to request that they block access to
        Flogapp Platforms.
      6. Commence legal action against you, whether for breach of contract or otherwise; and/or
      7. Suspend or delete your account on our Flogapp Website.
    2. Whereby in accordance with subsection ( 10.1.7) above; we suspend or prohibit or block
      your access to Flogapp Platforms or a part of it, you must not take any action to elude such suspension
      and/or prohibition and/or blocking including without limitation; creating and/or using a different
      account.
  11. Variations;
    1. The revised Terms of Service shall apply to the use of all Flogapp Platforms, from the date of
      publication of the revised Terms of Service on any Flogapp Platform, and you hereby waive any right you
      may otherwise have to be notified of, or to consent to, revisions of these Terms of Service.
    2. Flogapp will give you written notice of any revision of these Terms of Service, and the revised Terms of
      Service will apply to the use of our Flogapp Website from the date that we give you such notice; if you
      do not agree to the revised Terms of Service, you have prohibited from accessing any and all Flogapp
      Platforms.
    3. If you have given your express agreement to these Terms of Service, we will ask for your express
      agreement to any revision of these Terms of Service; and if you do not give your express agreement to
      the revised Terms of Service within such period as we may specify, we will disable or delete your
      account on Flogapp Platforms, additionally the User must stop using said Flogapp Platforms.
  12. Violations;
    1. If the User comes across any content that may violate our Terms of Service and/or our Community
      Standards, you should report it to us through the appropriate channels created to handle those issues as
      outlined in our Terms of Service. Our team reviews all cases. To protect individual privacy, the results
      of the investigation are not shared. You can review our Privacy Policy for more information.
    2. Users may receive a warning to their account for violations of our Terms of Service. A warning will be
      sent to the User’s email and will be displayed for such User on the Flogapp Website.
    3. Non Permitted Usage;
    4. Flogapp hereby declares that it will take all necessary legal and functional action needed against the
      User for the nullification and resolution of any non permitted action of the Flogapp Platforms, these
      non permitted actions shall include without limitation;
      1. Adult Services & Pornography – Flogapp hereby does not allow any exchange of adult
        oriented or pornographic materials and services.
      2.  Inappropriate Behavior & Language – Communication on any Flogapp Platform should
        be respectful, constructive, and professional. Flogapp hereby condemns bullying, harassment, and
        hate speech towards fellow Users.
      3. Phishing and Spam – Any and all attempts to publish or send malicious content with the
        intent to compromise another Users account or computer environment is strictly prohibited.
      4. Privacy & Identity – You may not publish or post other people’s private and
        confidential information. Any exchange of personal information required for the completion of a
        service and shall not be used for any purpose whatsoever other than for the delivery of the
        work.
      5. These Terms of Service will not protect any Users who engage and communicate off of Flogapp
        Platforms.
      6. Fraud / Unlawful Use – You may not use Flogapp for any unlawful purposes or to conduct
        illegal activities.
      7. Multiple Accounts – To prevent fraud and abuse, Users are limited to one active Flogapp
        account. Any additional account created to circumvent guidelines, promote competitive
        advantages, or mislead the Flogapp User’s, will be disabled.
      8. Targeted Abuse – Flogapp do not tolerate Users who engage in targeted abuse or harassment
        towards other users on Flogapp. This includes creating new multiple accounts to harass members
        through our message or ordering system.
  13. Confidentiality
    ;
    1. Users should recognize that there will/might be a need for Users to disclose confidential information to
      each other for the purpose of delivering the agreed upon work, and to protect such confidential
      information from unauthorized use and disclosure. Therefore, Users irrevocably agree to treat any
      information received from any User as highly confidential. Without derogating from the generality of the
      above, Users specifically agree to the following;
    2. Maintain all such information in strict confidence; and/or
    3. Not disclose the information to any third parties; and/or
    4. Not use the information for any purpose except for delivering the agreed upon work; and/or
    5. Not to copy or reproduce any of the information without the Users permission.
  14. Termination;
    1. Flogapp may terminate your access to all or any part of the Flogapp Platforms at any time, with or
      without cause, with or without notice, effective immediately. If you wish to terminate your usage of
      Flogapp Platforms, you may simply discontinue using the Flogapp Platforms. Notwithstanding the
      foregoing, if you materially breach these Terms of Service and fail to cure such breach within (14)
      fourteen days from Flogapp’s notice to you, thereof.
    2. Provided that, Flogapp can terminate Flogapp Platforms immediately as part of a general shut down of our
      services. All provisions of these Terms of Service, which by their nature should survive termination,
      shall survive termination, including, without limitation, ownership provisions, warranty disclaimers,
      indemnity and limitations of liability.
  15. Cancellation Policy for Home Services;
    1. Flogapp cancellation policy is designed to protect both the User and third-party Home Service
      Providers in the event of cancellation; the User can cancel the booking at no additional charge
      within sixty ( 60) seconds of creating the booking and/or up to twelve (
      12) hours in advance from the booking’s start time, in that situation the
      refund will be accepted and only the bank charges will be deducted from the User
    2. User(s) hereby acknowledge that cancellation due to reasons not attributable to Flogapp, such
      as, but not limited to, providing incorrect particulars, contact information, address, or when
      the User is either out of reach, unavailable or unresponsive for the purposes of fulfilling the
      Home Services offered, then the User shall be subject to late cancellation charge (as per table
      15.3, below).The policy shall be an integral part of our standard terms and conditions of use
      posted on our website and mobile application and may be changed at any time without prior
      notice.

  16. Reschedule policy for Home Service(s) ;
      1. Flogapp platform reschedule policy is designed to protect both the service user and the service
        provide in the event of any last-minute booking changes.
      2. The User can reschedule the appointment with no charges up to two (2) hours in advance from the
        booking’s start time by contacting Flogapp customer care.
      3. Late reschedule charges is applicable for any booking reschedule within two (2) hours of booking
        start time, since our team schedule is pre-planned, as per the following.The policy shall be an
        integral part of our standard terms and conditions of use posted on our website and mobile
        application and may be changed at any time without prior notice.

  17. Applicable Laws and Disputes;
    1. These Terms of Service shall be interpreted in accordance with the Federal laws of the United Arab
      Emirates (UAE) (hereby referred to as the “Relevant Laws”). All and any disputes or claims arising out
      of or in connection with these Terms of Service, shall be exclusively referred to and finally resolved
      by arbitration in Dubai in accordance with the Arbitration Rules of the Dubai International Arbitration
      Centre (DIAC) for the time being in force; which rules are deemed to be incorporated by reference into
      this provision and the User waive any objection to such proceedings on the grounds of venue or on the
      grounds that the proceedings have been brought in an inappropriate forum. All proceedings shall be
      conducted in the English language, in accordance with the Federal Laws of the United Arab Emirates. The
      tribunal shall comprise of one arbitrator to be agreed between the parties and if not so agreed, to be
      appointed by the DIAC. Subject to the arbitration provisions, the Courts at DIAC only shall have
      jurisdiction on issues relating to these Terms of Service.
    2. New and Changed Regulations: In the event that at any time and from time to time during
      the term of these Terms of Service any applicable laws, rules, regulations, decrees, agreements,
      concessions and arrangements (“Changed Regulations”). In the event that Changed Regulations become
      effective, whether by law, decree or regulation or by response to the insistence or request of any
      governmental or public authority or any person purporting to act therefore, and the material effect of
      such Changed Regulations (a) is not covered by any other provision of these Terms of Service, and (b)
      has a material adverse economic effect upon either party, Flogapp hereby declares its right to amend its
      Terms of Service and Privacy Policy and any other legal document in accordance with said Changed
      Regulation, thereof.
  18. Invalidity;
    1. If at any time any provision of these Terms of Service is or becomes illegal, invalid, void or
      unenforceable under the Relevant Laws, the legality, validity and enforceability of the remainder of
      these Terms of Service shall not be affected, and the legality, validity and enforceability of the whole
      of these Terms of Service in any other jurisdiction shall not be affected.
  19. Indemnification;
    1. Users agree to indemnify and hold harmless Flogapp, its contractors, and its licensors, and their
      respective directors, officers, employees and agents from and against any and all claims and expenses,
      including legal fees, arising out of your use of any of the Flogapp Platforms, including but not limited
      to your violation of these Terms of Service.
  20. Changes to our Terms of Service and Privacy Policy;
    1. From time to time we may make adjustments to the Terms of Service and Privacy Policy. Changes will be
      made at Flogapp’s sole discretion. Flogapp Platform Users are encouraged to check these Terms of Service
      and Privacy Policy. User’s continued use constitutes acceptance of the changes.

  22. Miscellaneous;
    1. These Terms of Service constitutes the entire Terms of Service between Flogapp and the User, concerning
      the subject matter hereof. These Terms of Service is made up of ( 20) twenty Sections
      and may be modified by a written amendment executed only by Flogapp and any authorized executive or
      legal counsel solely appointed by Flogapp. Any access to any of the Flogapp Platform’s will be governed
      by the Relevant Laws as defined within these Terms of Service.

If any part of these Terms of Service is held invalid or unenforceable, that part will be construed to reflect the parties’ original intent, and the remaining portions will remain in full force and effect. A waiver by either party of any term or condition of these Terms of Service or any breach thereof, in any one instance, will not waive such Terms of Service or any subsequent breach thereof.
